Welcome to Speakrphone!These Terms of Service ("Terms") govern your use of our platform, including our website, apps, and any related services (collectively referred to as the "Platform" or "Speakrphone").
By accessing or using Speakrphone, you agree to these Terms. If you do not agree, please do not use our services.
1. Introduction
- Speakrphone is a platform that allows speakers to create profiles, share talks, and connect with audiences.
- The words "we," "our," or "us" refer to Speakrphone, while "you" refers to any user accessing the Platform.
- Our Privacy Policy explains how we collect and use your data. Please review it carefully.
2. Changes to These Terms
- We may update these Terms at any time in our sole discretion to reflect business changes, legal requirements, or improvements to the Platform.
- For material changes, we will notify you via email or in-Platform notice before the changes take effect.
- For non-material changes (typo fixes, clarifications, reorganization), no notice is required.
- Your continued use of Speakrphone after the effective date of any update means you accept the revised Terms. If you do not agree, you must stop using the Platform.
3. Eligibility & Your Account
- You must be at least 13 years old to create an account.
- If you are under 18, you confirm that you have parental or guardian consent to use Speakrphone where required by law.
- If you create an account on behalf of a business or individual, you confirm that you have authorization to do so.
- Speakrphone uses OAuth-based authentication (Google Login) or email-based OTP instead of passwords. You are responsible for keeping your login credentials secure.
- If you believe your account has been compromised, contact us at support@speakrphone.com.
- You represent and warrant that you are not located in a country subject to U.S. government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. government list of prohibited or restricted parties.
- Verification. Speakrphone offers optional identity verification through LinkedIn. Verified users may receive enhanced visibility on the Platform (such as prominent placement in search results and discover feeds). Verification is granted at our discretion and may be removed if we determine it was obtained improperly or if you no longer meet our eligibility criteria.
4. Your Content
When we refer to your content, we mean any talks, transcripts, presentations, images, videos, links, or other materials you upload, share, or link to on Speakrphone.
By posting or linking to content on Speakrphone, you confirm that:
- You have the right to share the content (e.g., if linking to public YouTube videos or third-party presentations, they must be publicly available).
- Your content does not infringe on copyrights, trademarks, or any other legal rights.
- Your content is accurate and does not mislead or deceive others.
- Your content does not contain harmful software (e.g., viruses, bots, or automated scraping tools).
We may remove or restrict access to content that violates these Terms, our policies, or applicable laws. Users may also report content for review by our moderators.
5. What We Can Do With Your Content
- You retain ownership of any content you upload. However, if you link to external content (e.g., YouTube, Slideshare), ownership remains with the original content creator or platform.
- By posting or linking content on Speakrphone, you grant us a worldwide, royalty-free license to use, distribute, display, modify, and adapt your content for promoting and improving the Platform.
- Your content will be publicly accessible and may be shared by other users or indexed by search engines.
- Marketing & Publicity: You grant Speakrphone the right to use your name, username, profile picture, and public content in marketing materials, case studies, promotional materials, and similar communications related to the Platform. You may request removal of your name or likeness from specific materials by contacting support@speakrphone.com.
6. Prohibited Content & Activities
To maintain a safe and professional environment, Speakrphone does not allow:
- Explicit adult content (e.g., pornography, sexually explicit material).
- Hate speech, harassment, or discrimination based on race, gender, religion, nationality, disability, or sexual orientation.
- Encouragement of illegal activities, violence, self-harm, or extremist content.
- Fraud, scams, or misleading content (e.g., impersonation, deceptive business practices).
- Malware, phishing links, or other harmful software.
- Spamming, automated scraping, or excessive self-promotion.
Violating these rules may result in content removal, account suspension, or termination.
7. AI and Machine Learning Usage
- Speakrphone uses AI models (such as OpenAI and Anthropic) to improve search functionality, speaker recommendations, and content recommendations (e.g., suggesting relevant talks).
8. Automated Access & Data Extraction
- You may not use any automated means — including bots, scrapers, crawlers, data mining tools, or similar technologies — to access, extract, copy, harvest, or collect data or content from the Platform, except for: (a) search engine crawlers that obey our
robots.txtdirectives, and (b) other automated access we expressly authorize in writing. - You may not use content obtained from the Platform to train, fine-tune, or otherwise develop any machine learning or artificial intelligence model, except with our prior written permission.
- Violations may result in account suspension, termination, and legal action, and may constitute a breach of these Terms regardless of whether the access was technically prevented.
9. Intellectual Property & Use of Speakrphone Branding
- Speakrphone owns all intellectual property related to the Platform, including branding, logos, software, and features.
- You may use our logo or icon on any website, resume, LinkedIn, or social platform to showcase your Speakrphone profile.
- You may not modify or misrepresent our branding to falsely imply partnerships or endorsements.
10. Third-Party Links & Services
- Speakrphone allows users to share links to external content (e.g., YouTube, personal websites, donation pages).
- You are responsible for ensuring that any third-party content you link to complies with applicable laws.
Copyright Complaints (DMCA). Speakrphone primarily serves as a platform for linking to talks hosted on third-party services (YouTube, Spotify, personal websites, etc.) For copyright complaints about those talks, please contact the original hosting platform where the content lives. For copyright complaints involving content we host directly (e.g., user-uploaded thumbnails, headshots, or attachments), send a formal DMCA takedown notice to support@speakrphone.com with the subject line "DMCA Takedown Notice". Notices should include the elements required by 17 U.S.C. § 512(c)(3). We will terminate accounts of repeat infringers.
11. Account Suspension & Termination
- We may suspend, terminate, or delete your account at any time without notice if, in our sole discretion, you violate these Terms, abuse the Platform or other users, pose a risk to the Platform or its users, or use the Platform in a manner we determine to be unlawful, fraudulent, spammy, or otherwise harmful.
- We may also delete accounts that have been inactive for an extended period (generally 24 months or more), or that contain spam, placeholder, or low-quality content.
- If you believe your account was suspended or terminated in error, you may contact us at support@speakrphone.com.
- Upon termination, your right to use the Platform ends immediately. Any provisions of these Terms that by their nature should survive termination (including indemnification, limitation of liability, dispute resolution, and governing law) will survive.
12. Liability & Disclaimers
- Warranty Disclaimer. The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. To the fullest extent permitted by law, Speakrphone disclaims all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, and availability. We do not warrant that the Platform will be uninterrupted, error-free, secure, or free of viruses or other harmful components.
- You use Speakrphone at your own risk.
- Limitation of Liability.To the fullest extent permitted by law, Speakrphone's total aggregate liability to you for any and all claims arising out of or relating to these Terms, the Platform, or your use of Speakrphone will not exceed one hundred U.S. dollars ($100.00) or the fees you paid us in the twelve (12) months preceding the claim, whichever is greater. This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and applies even if any remedy fails of its essential purpose.
- In no event will Speakrphone be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, including lost profits, lost data, or business interruption, even if advised of the possibility of such damages.
- Beta and Experimental Features. We may offer features identified as beta, preview, experimental, or similar. These features are provided "as is", may be modified, changed, or discontinued at any time without notice, and are not subject to any service level commitments. Your use of beta features is at your own risk.
13. Governing Law, Arbitration & Dispute Resolution
These Terms are governed by the laws of the State of California, USA, without regard to conflict-of-law principles. Please read this section carefully. It requires you to resolve most disputes with Speakrphone through binding individual arbitration and waives your right to participate in a class action.
Pre-Arbitration Notice. Before initiating arbitration, you agree to notify Speakrphone at support@speakrphone.com with a description of your claim and any relief sought. The parties will attempt in good faith to resolve the dispute informally for 30 days before arbitration may be initiated.
Agreement to Arbitrate. You and Speakrphone agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform will be resolved through binding individual arbitration, and not in court, except that either party may (a) bring an individual action in small claims court if the dispute qualifies, or (b) seek injunctive or equitable relief in court for intellectual property infringement or misuse of the Platform.
Arbitration Rules. Arbitration will be administered by JAMS under its Streamlined Arbitration Rules, or by AAAunder its Consumer Arbitration Rules, at Speakrphone's election. Arbitration will take place in Santa Clara County, California, or via videoconference at your election, and will be conducted in English. The arbitrator's decision is final and binding.
Arbitration Fees. For claims under $10,000, Speakrphone will pay all arbitration filing and administrative fees. For larger claims, fees will be allocated per the applicable arbitration rules.
Class Action Waiver. You and Speakrphone each agree that disputes will be brought only in an individual capacity, not as a plaintiff or class member in any purported class, consolidated, or representative proceeding. The arbitrator may not consolidate more than one person's claims or preside over any form of representative or class proceeding.
Jury Trial Waiver. To the extent permitted by law, you and Speakrphone each waive the right to trial by jury for any claim arising out of or relating to these Terms.
30-Day Opt-Out. You may opt out of this arbitration agreement by sending written notice to support@speakrphone.com within 30 days of first accepting these Terms. Your notice must include your name, email, and a clear statement that you opt out of arbitration. Opting out does not affect any other provision of these Terms.
Time Limit on Claims. Any claim or cause of action arising out of or relating to these Terms must be commenced within one (1) year after the claim arose, or it is permanently barred.
14. Indemnification
You agree to indemnify, defend, and hold harmlessSpeakrphone and its operators, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
- Your use of the Platform;
- Your content, including any claim that it infringes intellectual property rights, violates privacy or publicity rights, or is otherwise unlawful;
- Your violation of these Terms or any applicable law;
- Your violation of any third-party right.
We reserve the right, at your expense, to assume exclusive defense and control of any matter subject to indemnification by you, and you agree to cooperate with our defense of any such claim.
15. Changes & Termination
- We may update, modify, or discontinue features at any time.
- If you disagree with any changes, you must stop using Speakrphone.
- If we discontinue the Platform, we will attempt to notify users in advance.

17. Miscellaneous
Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Speakrphone regarding your use of the Platform and supersede all prior or contemporaneous communications, whether oral or written.
Severability. If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will continue in full force and effect.
No Waiver. Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other provision. Any waiver must be in writing and signed by us.
Assignment. Speakrphone may assign or transfer these Terms, in whole or in part, at our sole discretion, including in connection with a merger, acquisition, reorganization, or sale of assets, or to a successor entity (such as a newly formed company). You may not assign or transfer these Terms or any of your rights or obligations under these Terms without our prior written consent.
Force Majeure. Speakrphone will not be liable for any failure or delay in performance due to events outside our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, civil unrest, government action, labor disputes, pandemics, internet outages, failures of third-party service providers, or any other force majeure event.
Electronic Communications. By using Speakrphone, you consent to receive communications, notices, and disclosures from us electronically (via email or in-Platform notifications). Electronic communications will satisfy any legal requirement that such communications be in writing.
Survival. Provisions that by their nature should survive termination of these Terms will survive, including sections on Your Content, Prohibited Content, Intellectual Property, DMCA, Account Termination, Indemnification, Liability Disclaimers, Dispute Resolution, Governing Law, and this Miscellaneous section.
